Terms of service

These Terms and Conditions apply to all offers, orders, agreements, and deliveries of Cuppix, established in Schiedam, the Netherlands.

By using this website and/or placing an order, the customer expressly agrees to these Terms and Conditions.

1. Product categories and personalization

Cuppix sells:

• Standard products

• Personalized (printed) products

Personalized products are defined as products that are provided with a logo, name, design, text, or other customer-specific print at the customer’s request.
Selecting a color only is not considered personalization.

The customer is fully responsible for the accuracy of the submitted design and for its final approval prior to production.
After approval of the design, cancellation, modification, or withdrawal is no longer possible.

2. Right of withdrawal – private customers (B2C)

For standard products, private customers have a statutory right of withdrawal of 14 days, provided the product is returned unused and in its original condition.

The right of withdrawal is expressly excluded for personalized products that are manufactured according to the customer’s specifications, in accordance with applicable consumer legislation.

3. Business customers (B2B)

For business customers, no right of withdrawal applies.
Orders placed by business customers are binding and cannot be cancelled, unless otherwise agreed in writing.

Returns from business customers are accepted only if the product has demonstrably been delivered damaged.

4. Damaged products and burden of proof

If a product is delivered damaged, the customer must notify Cuppix immediately upon receipt.

The customer is required to provide clear and sufficient evidence (photos and/or videos) clearly showing the damage.
Without such evidence, Cuppix is not obliged to replace, repair, or refund the product.

5. Agreements and execution

An agreement is concluded only after Cuppix has confirmed an order in writing or electronically.
Cuppix reserves the right to refuse or cancel orders without stating reasons.

6. Liability

The liability of Cuppix is in all cases limited to the amount of the relevant order.

Cuppix shall not be liable for:

• indirect damage;

• consequential damage;

• business damage;

• loss of profit;

• damage resulting from improper use of the product.

Except in cases of intent or gross negligence.

7. Intellectual property

All intellectual property rights relating to the website, designs, images, texts, and logos belong exclusively to Cuppix or its licensors.

Use, reproduction, or distribution without prior written consent is strictly prohibited.

8. Governing law and disputes

All legal relationships with Cuppix are governed exclusively by Dutch law.
Disputes shall be submitted exclusively to the competent court in the Netherlands.
